Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online store. Our online store is exclusively intended for consumers. By placing your order, you automatically agree to the terms and conditions.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside of their commercial or independent professional activity. An entrepreneur is a natural or legal person, or a legally capable partnership, who acts in the exercise of their commercial or independent professional activity when entering into a legal transaction.

2. Contract Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Khroom GmbH.

By listing the products in the online store, we make a binding offer to conclude a contract for these items. You may first place our products in the shopping cart without obligation and correct your entries before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Language of the Contract, Storage of Contract Text

The language available for the conclusion of the contract is German.

We store the contract text and send you the order details and our terms and conditions via email. You can view the contract text in our customer login.

Your order constitutes an offer to us to conclude a purchase contract. When you place an order, we will send you a message confirming the receipt of your order and detailing the specifics (order confirmation). This order confirmation does not constitute acceptance of your offer. A purchase contract is only concluded when we ship the ordered product to you and confirm the shipment with a second email or a message in your message center in your customer account (shipping confirmation). We may withdraw from the order or cancel the purchase contract at any time if the conditions in the product description do not apply to the customer.

4. Delivery Terms

In addition to the listed product prices, shipping costs may apply. Further details on any potential shipping costs can be found in the offers.

5. Payment

The following payment methods are generally available in our shop:

Prepayment
When choosing prepayment as the payment method, we will provide our bank details in a separate email, and the goods will be shipped after payment has been received.

Credit Card
By placing the order, you simultaneously provide us with your credit card details.

After your authorization as the rightful cardholder, we will immediately request your credit card company to initiate the payment transaction. The payment transaction will be automatically processed by the credit card company, and your card will be charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you must be registered with PayPal or register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we will request PayPal to initiate the payment transaction. The payment transaction will be automatically processed by PayPal immediately afterward. Additional instructions will be provided during the ordering process.

Sofort by Klarna
After placing the order, you will be redirected to the Sofort GmbH website. To pay the invoice amount via Sofort, you must have an online banking account activated for Sofort participation with PIN/TAN procedure, authenticate accordingly, and confirm the payment instruction to us. Further instructions will be provided during the ordering process. The payment transaction will be immediately carried out by Sofort, and your account will be debited.

Giropay

After placing the order, you will be redirected to your bank's website. To pay the invoice amount via Giropay, you must have an online banking account activated for Giropay participation with PIN/TAN procedure, authenticate accordingly, and confirm the payment instruction to us. Further instructions will be provided during the ordering process. The payment transaction will be immediately processed, and your account will be debited.

Amazon Pay

During the ordering process, you will be redirected to the Amazon website before completing the order in our online shop. To complete the order process and pay the invoice amount via Amazon, you must be registered with Amazon or register, authenticate with your access data, and confirm the use of your stored shipping address and payment method along with the payment instruction to us. Afterward, you will be redirected back to our online shop to finalize the order process.

Immediately after placing the order, we will request Amazon to initiate the payment transaction. The payment transaction will be automatically processed by Amazon. Additional instructions will be provided during the ordering process.

Invoice Purchase via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice purchase as a payment option. Please note that Klarna invoice is only available for consumers and that payment must be made directly to Klarna. With invoice purchase via Klarna, you always receive the goods first, and you have a payment term of 14 days. You can find the complete terms and conditions for invoice purchase here.

Cash Payment on Pickup
You pay the invoice amount in cash when picking up the goods.

6. Retention of Title

The goods remain our property until full payment is made.

7. Transport Damage

If goods are delivered with visible transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to file a complaint or contact us will not affect your statutory rights and their enforcement, especially your warranty rights. However, it helps us assert our own claims against the carrier or the transport insurance.

8. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory warranty rights apply.
For used goods: if the defect occurs after one year from delivery of the goods, the warranty claims are excluded. Defects that occur within one year from delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above limitations and shortened periods do not apply to claims arising from damage caused by us, our legal representatives, or vicarious agents
• in cases of injury to life, body, or health
• in cases of willful or grossly negligent breach of duty or fraud
• in cases of violation of essential contractual obligations, the fulfillment of which is necessary for the proper performance of the contract and on which the contracting partner can regularly rely (cardinal duties)
• within the scope of a warranty promise, if agreed or
• as far as the scope of the Product Liability Act is applicable.

8.1 Return:

The withdrawal period is 30 days. During this period, you may return the item without giving a reason. The item must be in the condition in which you received it. Khroom may claim depreciation. The item should be returned in a resalable condition and cleaned if necessary. The return must be sent to our return address. Returns to the company's headquarters (not the returns warehouse) are held for 14 days for collection before being disposed of. The return must be complete and in the correct packaging.

9. Liability

We are fully liable for claims arising from damages caused by us, our legal representatives, or vicarious agents
• in cases of injury to life, body, or health
• in cases of willful or grossly negligent breach of duty
• in cases of warranty promises, if agreed, or
• as far as the scope of the Product Liability Act is applicable.
For breach of essential contractual obligations, the fulfillment of which is necessary for the proper performance of the contract and on which the contracting partner can regularly rely (cardinal duties) due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the damage that is foreseeable at the time of the contract conclusion, with damage that typically can be expected.
In all other cases, claims for damages are excluded.

10. Dispute Resolution

We are willing to participate in an out-of-court dispute resolution procedure before a consumer dispute resolution body.
